The question posed by this interlocutory appeal is whether the Circuit Court of the Second Circuit can entertain a suit for damages resulting from the allegedly unlawful termination of Plaintiff-appellee Robert P. Gouveias employment by Napili-Kai, Ltd., an employer subject to the National Labor Relations Act. Since Gouveias complaint avers the discharge stemmed from an attempt to engage in collective bargaining with the employer and federal law and procedures govern the employers obligations in this regard, we conclude the circuit court erred in denying Napili-Kais motion to dismiss the action.
